  1. Introduction and Scope

Jeff Periera Home Energy (“Company,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information in connection with your use of JPHomeEnergy.com and related services (collectively, the “Site”), including our use of cookies, pixels, and similar tracking technologies, and our collection and use of email addresses and telephone numbers.

This Policy applies to information collected through the Site, through your communications with us (including by email, phone, and text message), and through our online advertising. It does not apply to third-party websites, applications, or services that we do not own or control, even if linked from the Site.

By accessing or using the Site, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, you should discontinue use of the Site.

  1. Categories of Personal Information We Collect and Disclose

The categories below summarize the personal information we may collect about Site visitors, consistent with the categories defined under the California Consumer Privacy Act (CCPA), as amended, along with examples of each category and the business purposes for which such information may be disclosed to third parties. Not every category applies to every visitor or every site; this list should be adjusted to reflect the site’s actual practices.

  • Identifiers — such as name, email address, postal address, phone number, IP address, online identifiers, and device ID.

  • Geolocation Data — approximate location derived from IP address.

  • Audio/Visual Information — such as call recordings, where disclosed and permitted by law. Collected: If applicable. Disclosed to service providers (e.g., a call tracking vendor).
  • Professional or Employment Information — such as company name or job title, if provided. Collected: If applicable. Disclosed to service providers.
  • Inferences — inferences about preferences drawn from the categories above.
    Collected: If applicable. Disclosed to analytics/advertising partners.
  • Sensitive Personal Information — such as precise geolocation or account log-in credentials. Collected: If applicable. Disclosed to service providers.

We collect personal information directly from you (e.g., when you complete a form), automatically through your use of the Site (e.g., through cookies and pixels), and from third parties (e.g., advertising and analytics partners, data enrichment providers, and social media platforms).

  1. Cookies and Similar Tracking Technologies

What Cookies Are

Cookies are small text files placed on your device when you visit a website. Our third-party partners and we use cookies, web beacons, local storage, and similar technologies (collectively, “cookies”) to operate the Site, remember your preferences, analyze usage, and deliver relevant advertising.

Categories of Cookies We Use

  • Strictly Necessary — enable core site functionality, security, load balancing, and remembering your cookie consent choices. Example providers: Jeff Periera Home Energy hosting provider. Typical duration: session to 1 year.
  • Functional — remember preferences such as language or region. Typical duration: up to 1 year.
  • Analytics/Performance — measure traffic, page views, and site usage to improve the Site. Example providers: Google Analytics. Typical duration: up to 2 years.
  • Advertising/Targeting — deliver relevant ads, measure ad performance, and build retargeting and lookalike audiences. Example providers: Google Ads, Meta, Microsoft Ads, LinkedIn, TikTok. Typical duration: up to 2 years.

Cookie Consent Management

When you first visit the Site, a cookie consent banner allows you to accept, reject, or customize non-essential cookies by category. Your preferences are stored and can be changed at any time through the cookie preferences link, typically located in the Site footer. Strictly necessary cookies cannot be disabled because the Site cannot function properly without them.

Browser and Device Controls

Most browsers allow you to block or delete cookies through their settings, and mobile devices allow you to limit ad tracking through device-level settings. Blocking cookies may impact the functionality of the Site and may still allow essential cookies to operate. Where you have enabled a Global Privacy Control (GPC) signal, we will treat that signal as a request to opt out of the sale/sharing of your personal information for this browser and device, as described in Section 9.

Do Not Track

Some browsers offer a “Do Not Track” (DNT) signal. Because there is not yet an accepted industry standard for recognizing DNT signals, the Site does not currently respond to DNT browser signals; however, we do honor GPC signals as described above and provide the cookie and opt-out choices described throughout this Policy.

  1. Pixels, Tags, and Advertising Technologies

We use tracking pixels and tags, deployed in many cases through a tag management system such as Google Tag Manager, to measure advertising performance, build audiences for retargeting and lookalike advertising, and understand how visitors interact with the Site across devices. Depending on the site, this may include, but are not limited to:

  • Meta Pixel — collects information about your interactions with the Site to measure and improve Meta (Facebook/Instagram) advertising and build custom or lookalike audiences. Opt out of Meta’s use of this data for ads through your Meta ad preferences at facebook.com/ad preferences.
  • Google Ads and Google Analytics tags — measure conversions, site traffic, and user behavior, and support remarketing through the Google network. Manage Google ad personalization at adssettings.google.com, or opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on.
  • Microsoft Ads (Bing) tag — measures conversions and supports remarketing on the Microsoft advertising network. Manage preferences at Microsoft’s advertising opt-out page.
  • LinkedIn Insight Tag — measures conversions from LinkedIn campaigns and supports retargeting to LinkedIn members. Manage preferences through LinkedIn account settings.
  • TikTok Pixel — measures conversions and supports retargeting to TikTok users. Manage preferences through TikTok account settings.
  • Call tracking technology — assigns tracking phone numbers to measure which marketing campaigns generate phone inquiries, and may record calls where disclosed at the start of the call and permitted by applicable law.

You may also manage interest-based advertising broadly through the Digital Advertising Alliance (optout.aboutads.info) or the Network Advertising Initiative (optout.networkadvertising.org). Opting out of a specific advertising network does not opt you out of all advertising, and you may still see non-personalized ads.

  1. Email Collection and Use

Why We Collect Email Addresses

We collect email addresses when you submit a contact, quote, or appointment form; subscribe to a newsletter; make a purchase; create an account; or otherwise provide your email address to us or our service providers.

How We Use Email Addresses

  • To respond to inquiries and deliver requested information, quotes, or services
  • To send transactional communications, such as confirmations, receipts, appointment reminders, and account or service notifications
  • To send marketing communications, such as newsletters, promotions, and product or service updates, where you have subscribed, made a purchase, or otherwise provided consent consistent with applicable law
  • To personalize and improve our communications, measure email engagement (such as opens and clicks), and maintain suppression lists of individuals who have opted out

Your Choices and CAN-SPAM Compliance

Every marketing email includes a clear and conspicuous unsubscribe mechanism. We honor unsubscribe requests promptly and in any event within the timeframe required by the CAN-SPAM Act. Marketing emails will accurately identify the sender, avoid deceptive subject lines, and include a valid physical postal address. We do not sell email addresses to unrelated third parties. Even after you opt out of marketing emails, we may continue to send you transactional or account-related emails necessary to provide services you have requested.

Email Service Providers

We use third-party email service providers to store email lists and deliver communications on our behalf. These providers are contractually restricted from using your email address for their own independent marketing purposes.

  1. Phone Number Collection and Use

Why We Collect Phone Numbers

We collect phone numbers when you submit a contact, quote, or appointment form; call or text us; provide a number during a customer service interaction; or otherwise opt in to receive calls or text messages from us.

How We Use Phone Numbers

  • To respond to inquiries and provide requested information or services
  • To send appointment reminders, order updates, or other service-related notifications
  • To place marketing or promotional calls or text messages, only where you have provided prior express written consent as required by applicable law
  • To support call tracking and campaign analytics, which may involve assigning a unique tracking number to a marketing source and, where disclosed and legally permitted, recording the call for quality and training purposes

Text Messaging (SMS/MMS) Program

If you opt in to receive text messages from Jeff Periera Home Energy (for example, by submitting a form with SMS consent language or texting a keyword to us), the following applies:

  • Message and data rates may apply, and message frequency will vary based on your interactions with us.
  • You may opt out of text messages at any time by replying “STOP” to any message; you will receive a one-time confirmation that you have been unsubscribed.
  • You may reply “HELP” for assistance, or contact us using the information in Section 15.
  • Consent to receive text messages is not a condition of purchasing any goods or services.
  • Carriers are not liable for delayed or undelivered messages.
  • We collect and use mobile opt-in information and consent in accordance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and other applicable telemarketing and messaging laws. Mobile opt-in data and consent are not shared with third parties for their own marketing purposes.

Do-Not-Call and Call Recording

We maintain and honor an internal do-not-call list and comply with the National Do Not Call Registry with respect to telemarketing calls, where applicable. Where calls are recorded, we provide notice at the start of the call, and, where required by two-party consent state law, will obtain your consent before recording.

In addition to the specific uses described above, we may use personal information to:

  • Operate, maintain, and improve the Site and our products and services
  • Process and fulfill orders, requests, or transactions
  • Personalize content and measure the effectiveness of our marketing and advertising
  • Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity
  • Comply with legal obligations and enforce our agreements and policies
  • Communicate with you about your account, transactions, or inquiries
  1. How We Share and Disclose Information

We may disclose personal information to the following categories of recipients, for the business purposes described throughout this Policy:

  • Service providers, such as website hosting, IT, analytics, email/SMS delivery, CRM, call tracking, and payment processing vendors, who are contractually restricted from using personal information for purposes other than providing services to us
  • Advertising and analytics partners, such as Google, Meta, Microsoft, LinkedIn, and TikTok, as described in Section 4
  • Professional advisors, such as legal, accounting, insurance, or other consultants
  • Government authorities, regulators, or other parties, where required by law, subpoena, or legal process, or to protect the rights, property, or safety of Jeff Periera Home Energy, our users, or others
  • A successor entity, in connection with a merger, acquisition, reorganization, bankruptcy, or sale of some or all company assets
  • Other parties, with your consent or at your direction

“Sale” and “Share” of Personal Information: We do not sell personal information to third parties in exchange for money. However, our use of advertising cookies and pixels described in Sections 3 and 4 to deliver interest-based advertising may be considered a “sale” or “share” of personal information under the CCPA and similar state laws. Section 9 explains how to opt out of this activity.

  1. Your Privacy Rights and Choices

All Visitors

  • Manage cookie preferences through the cookie consent banner or your browser settings (Section 3)
  • Opt out of interest-based advertising broadly through the DAA or NAI opt-out tools, or platform-specific tools (Section 4)
  • Unsubscribe from marketing emails via the link in any marketing email (Section 5)
  • Opt out of text messages by replying STOP (Section 6)
  • Enable a Global Privacy Control (GPC) signal in a supported browser to signal an opt-out of sale/sharing for that browser

California Residents (CCPA/CPRA)

If you are a California resident, you have the right, subject to certain exceptions, to:

  • Know/Access: request the categories and specific pieces of personal information we have collected, used, disclosed, and sold/shared about you
  • Delete: request deletion of personal information we have collected from you
  • Correct: request correction of inaccurate personal information
  • Opt-Out: opt out of the “sale” or “sharing” of your personal information, including for cross-context behavioral advertising, using the “Do Not Sell or Share My Personal Information” link on the Site or by submitting a request as described in Section 15
  • Limit Use of Sensitive Personal Information: request that we limit the use of sensitive personal information to purposes permitted under the CCPA, to the extent we collect such information
  • Non-Discrimination: we will not discriminate against you for exercising any of these rights

To exercise these rights, submit a request using the contact information in Section 15. We will verify your identity before fulfilling requests to know, delete, or correct, using information you have already provided to us; you may also designate an authorized agent to submit a request on your behalf, subject to verification. We will respond within the time period required by law (generally 45 days, extendable once by an additional 45 days with notice), and any denial will explain the basis for denial and any available appeal process.

Other U.S. State Privacy Laws

Residents of certain other states with comprehensive privacy laws — including, as of this Policy’s effective date, Virginia, Colorado, Connecticut, Utah, Oregon, Texas, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, and others as such laws take effect — may have similar rights to confirm processing, access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, the sale of personal information, and, in some states, certain profiling. Nevada residents may separately submit a request to opt out of the sale of certain covered information under Nevada law. To exercise any applicable state right, contact us using the information in Section 15.

European Economic Area, UK, and Other International Visitors

If you are located in the European Economic Area, United Kingdom, or a jurisdiction with its own comprehensive data protection framework, we process personal information on the legal bases of consent, performance of a contract, compliance with a legal obligation, and/or our legitimate interests in operating and marketing the Site. You may have the right to access, rectify, erase, or restrict processing of your personal information; to object to processing (including direct marketing); to data portability; and to lodge a complaint with your local data protection supervisory authority. Where personal information is transferred outside your jurisdiction, we rely on appropriate safeguards, such as standard contractual clauses, where required.

  1. Sensitive Personal Information

We do not intentionally collect Social Security numbers, government ID numbers, precise geolocation, financial account credentials, health information, or similarly sensitive categories of information through the Site unless you voluntarily provide it (for example, in a form field or message) or it is otherwise necessary to provide a specific service you request. Where such information is collected, we limit its use to the purpose for which it was provided and applicable legal requirements. 

  1. Automated Decision-Making

We do not currently use personal information to make decisions that produce legal or similarly significant effects about you through solely automated means without human involvement. If this changes, we will update this Policy and provide any disclosures required by applicable law.

  1. Children’s Privacy

The Site is not directed to children under the age of 13 (or 16, where applicable under state law), and we do not knowingly collect personal information from children within those age ranges without appropriate parental consent. If we learn that we have collected personal information from a child in violation of applicable law, we will take steps to delete that information. Parents or guardians who believe we may have collected information from a child should contact us using the information in Section 15.

  1. Data Retention and Security

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements, after which it is deleted, anonymized, or de-identified in accordance with our internal retention practices.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. In the event of a security incident affecting your personal information, we will notify affected individuals and applicable regulators as required by law.

  1. Third-Party Links and Services

The Site may contain links to third-party websites, plugins, and applications that we do not own or control. Clicking those links or enabling those connections may allow third parties to collect or share information about you. We are not responsible for the privacy practices of any third party, and we encourage you to review the privacy policy of every website you visit.
